These Terms of Use ("Terms") govern your access to the StayLuxe website and apps operated by StayLuxe Hospitality Pvt. Ltd. By browsing, creating an account or making a booking, you accept these Terms. Please also review our Privacy Policy, Refund Policy and Cancellation Policy, which form part of this agreement.
1. Acceptance of Terms
StayLuxe is an online marketplace connecting travellers with independently operated accommodation providers ("Hotels"). When you book, a direct contract for the stay is formed between you and the Hotel; StayLuxe facilitates the booking, payment and support. We may update these Terms from time to time — material changes are notified by email at least 15 days before they take effect, and continued use constitutes acceptance.
2. Eligibility & Accounts
- You must be at least 18 years old and legally capable of entering contracts to book on StayLuxe.
- You are responsible for the accuracy of guest information and for safeguarding your login credentials and OTPs.
- One person, one account. Accounts engaged in fraudulent activity, coupon abuse or reselling may be suspended after review.
3. Bookings & Payments
- A booking is confirmed only when you receive a confirmation voucher with a StayLuxe Booking ID.
- Hotels may deny check-in without a valid government photo ID matching the guest name; such denial is treated as a no-show.
- Unmarried couples, guests below 18, and pets are subject to each Hotel's individual policy, displayed on the property page before payment.
- "Pay at Hotel" bookings may require a card guarantee and can be cancelled by the Hotel if you fail its confirmation call.
4. Pricing, Taxes & Coupons
- All prices are in Indian Rupees (₹) unless another currency is selected; taxes and fees are itemised before payment.
- Obvious pricing errors (e.g. a suite listed at ₹1) may be cancelled with a full refund even after confirmation.
- Coupons carry their own conditions — validity, minimum spend, property categories — and one coupon applies per booking.
- The best-price guarantee applies to identical room, dates and cancellation plan on a comparable platform, claimed within 24 hours of booking.
5. User Conduct
You agree not to:
- Scrape, copy or resell StayLuxe content, rates or inventory;
- Post fake, defamatory or paid reviews — reviews must reflect a genuine completed stay;
- Use the platform for any unlawful purpose or to harass Hotel staff or other guests;
- Circumvent StayLuxe to complete a discovered booking directly, where a StayLuxe promotion was used to discover the property.
6. Intellectual Property
The StayLuxe name, logo, design system, editorial content and software are owned by StayLuxe Hospitality Pvt. Ltd. or its licensors. Hotel photography is licensed to us by partner properties. You may not reproduce, modify or distribute any platform content without prior written permission, except for personal, non-commercial use of your own booking documents.
7. Limitation of Liability
StayLuxe verifies listings through a 200-point audit but does not own or operate Hotels. To the maximum extent permitted by law:
- Our aggregate liability for any booking is limited to the total amount paid to StayLuxe for that booking;
- We are not liable for indirect or consequential losses, or for events at the property outside our control (e.g. force majeure, utility outages, local restrictions);
- Where a Hotel fails to honour a confirmed booking, our relocation-or-full-refund promise in the Cancellation Policy applies.
8. Governing Law & Disputes
These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of Panaji, Goa, after a mandatory 30-day good-faith resolution period with our support team. Nothing in these Terms limits your rights under the Consumer Protection Act, 2019. Questions about these Terms can be sent to legal@stayluxe.com.
